What is Mediation?
Mediation is a structured, non-adversarial dispute resolution process.
In which a neutral third party, typically an experienced family law attorney agreed upon by both parties, facilitates negotiations to resolve your case outside the courtroom. Mediation is required in most family law matters in Florida and frequently results in partial or complete settlement of disputed issues.
The Mediation Process
Mediation can occur at any stage of a case, before filing suit, during active litigation, or immediately before trial.
The mediator meets separately with each party, communicating proposals and exploring settlement positions to identify common ground and workable compromises. Rather than imposing decisions, the mediator creates space for both sides to reach a mutually acceptable resolution with the assistance of experienced legal guidance.
Advantages of Settling Through Mediation
Resolution through mediation offers significant advantages over trial outcomes.
When parties settle at mediation, they maintain control over the final agreement and can craft outcomes tailored to their specific circumstances and priorities. Unlike trial, where a judge has absolute authority to decide contested matters and may be constrained by law from making certain rulings, mediation allows for creative, flexible solutions that satisfy both parties’ core interests.
Settlement through mediation also typically results in faster resolution, reduced litigation costs, and less adversarial proceedings that can be particularly beneficial when ongoing relationships (such as co-parenting) must continue after the case concludes.
JJ Family Law's Mediation Strategy
JJ Family Law approaches mediation as an opportunity to strategically advance your interests while remaining open to fair and reasonable resolutions.
We prepare thoroughly for mediation by analyzing all relevant facts, financial data, legal precedents, as well as having our experts attend mediation. We do everything possible to maximize the chances for a successful resolution at mediation.
When settlement opportunities exist that serve your long-term interests, we advocate for them decisively. Conversely, when opposing parties take unreasonable positions, we are prepared to pursue your case through trial with the same aggressive commitment that defines our litigation practice.
