Determining and Enforcing Child Support Obligations

Child support is a legal obligation rooted in both parents' responsibility to contribute to their children's financial needs and well-being.

Florida’s child support guidelines establish a framework for calculating support based on each parent’s income, the amount of time each parent spends with the child, and the child’s specific needs. Unlike alimony, which may be modified or terminated under certain circumstances, child support obligations continue until the child reaches the age of majority or, in some situations, until graduation from high school or completion of post-secondary education.

Income Calculation and Determining Support Obligations

Calculating child support requires accurately determining each parent's income from all sources.

Including W2 wages, self-employment income, bonuses, investment income, and other compensation. Courts may impute income to a parent who is underemployed or deliberately underearning to avoid support obligations.

JJ Family Law works with forensic accountants to analyze income thoroughly, ensuring that support calculations reflect true earning capacity and actual financial circumstances. We challenge inflated income claims and defend against unfounded income imputations that do not reflect reality.

Adjusting Support for Substantial Changes in Circumstances

Child support obligations may be modified when substantial changes in circumstances occur such as significant income changes.

Modifications to timesharing arrangements, or substantial changes in a child’s needs. Parents cannot simply agree to lower child support without court approval, and Florida courts carefully scrutinize modifications to ensure that changes serve the child’s best interest. JJ Family Law helps clients evaluate whether circumstances justify modification and pursues appropriate adjustments when warranted.

Enforcement When Support Is Not Paid

When child support obligations are not met, enforcement becomes necessary to protect your child's financial security.

Unpaid child support creates arrearage that accumulates with interest. JJ Family Law aggressively enforces child support obligations through income withholding orders, garnishment, asset seizure, and contempt proceedings.

We understand that child support delays directly impact your child’s daily needs and well-being, and we work to expedite collection through available enforcement mechanisms.

Defending Against Unfounded Child Support Claims

Not all child support claims are accurate or justified.

When financial circumstances do not support claimed income levels or when timesharing has changed significantly, child support obligations may be incorrectly calculated or excessive. JJ Family Law defends clients against inflated child support demands and challenges calculations that do not reflect actual circumstances.

We also represent obligors facing enforcement actions based on changed circumstances that reduce ability to pay, ensuring that contempt or enforcement does not occur when legitimate inability to pay exists.
